Bally Gaming and Top Gun Gaming LLC signed a licensing deal in January 2003, whereby Bally Gaming committed to pay Top Gun a set amount of royalties in exchange for the Betty Boop concepts including one for Betty Boop's Love Meter. Bally informed Top Gun in November 2007 that the trademark license was permitted to expire on December 31, 2007.
Top Gun was notified in 2010 that Bally Gaming had reclaimed the rights to the Betty Boop brand and had licensed the film's ideas for use on video games. Bally was sued by Top Gun for unpaid royalties.
