The chubby Helen Kane, who claims to have “originated” the “Boop-Boop-a-Doop” manner of singing, was ready to go to trial today with her $250,000 action against Paramount-Publix Corporation and others for adopting her idea, but Supreme Court Justice Julius Miller found too many unfinished trials ahead and adjourned the action until Monday.
Besides the quarter of a million dollars, she asks for an injunction to restrain the defendants from continuing to use her mannerisms. The defendants, besides claiming themselves to have “originally created” the mannerisms in question, had in court three girls who look a great deal like Miss Kane and who sing like her, too. They are Mae Questel, the voice behind “Betty Boop” of talkie cartoon fame; Margie Hines and Bonnie Poe. The other defendants are Max Fleischer and the Max Fleischer Studios, which produced animated cartoons distributed by Paramount-Publix.
